Drug-Free Workplace Act of 1988
Determining Coverage for Individuals with Contracts
This contract is covered by the Drug-Free Workplace Act of
1988.
Regardless of dollar value of the contract, all contracts awarded to
individuals are covered and required to include a clause that states they will
not engage in unlawful manufacture,
distribution, dispensation, possession or use of a controlled
substance in the performance of the contract.
By signing an agreement for a contract or grant with the Federal government, you agree to
comply with the requirements of the Act.
A contractor who fails to comply with the above
requirements faces certain penalties.
Although all contracts and grants to individuals are similarly covered, some contracts awarded to organizations may not be covered. Also, requirements for covered organizations are more extensive than for individuals.
