Drug-Free Workplace Act of 1988
When the Act Applies

Organizations

All organizations with grants from a U.S. Federal agency must comply with the provisions of the Drug-Free Workplace Act of 1988.  Furthermore, all organizations with contracts with U.S. Federal agencies must comply if the contract is:

  1. In the amount of $100,000 or more;
  2. Not for the acquisition of commercial goods (i.e., it is a procurement contract or purchase order); and
  3. Performed in part or in whole in the United States.

Individuals

All individuals with grants or contracts from any U.S. Federal agency are covered by the Act, regardless of dollar volume.
