12/16/92 U.S. v. Schenkel's All Star Dairy, Inc.; Six S Corporation d/b/a Pure Sealed Dairy; Thomas T. Schenkel; Jerome W. Bullis; and Gerald B. Widenhofer
Criminal No.: HCR-92-180 (N.D. Ind.)

One-count indictment was filed in U.S. District Court in Hammond, Indiana, charging Schenkel's All Star Dairy, Inc. of Huntington, Indiana; Six S Corporation d/b/a Pure Sealed Dairy of Fort Wayne, Indiana; Thomas T. Schenkel, president of Six S Corporation and vice president of sales for Schenkel's All Star Dairy, Inc.; Jerome W. Bullis, former general manager of Allen Dairy Products, Inc.; and Gerald B. Widenhofer, sales manager of Allen Dairy Products, Inc., with conspiring to rig bids, in violation of Section 1 of the Sherman Act, for the award and performance of contracts to supply milk to schools and school districts in a nine-county area in northern Indiana and a two-county area in southern Michigan, beginning at least as early as 1985 and continuing at least into 1988.

12/17/92 U.S. v. Bolar Pharmaceutical Co., Inc.; Vitarine Pharmaceuticals, Inc.; Lawrence S. Raisfeld; and Roger W. Jordan

One-count indictment was filed in U.S. District Court in Baltimore, Maryland, charging Bolar Pharmaceutical Co., Inc. of Copiague, New York and its president, Lawrence S. Raisfeld, and Vitarine Pharmaceuticals, Inc. of Springfield Gardens, New York and its president, Roger W. Jordan, with conspiring to fix the price, in violation of Section 1 of the Sherman Act, of generic Dyazide, beginning as early as February 1988 and continuing through April 1989. Generic Dyazide is a drug generally prescribed for the treatment of hypertension or high blood pressure.

12/17/92 U.S. v. Jack B. Vance

One-count information was filed in U.S. District Court in Jackson, Mississippi, charging Jack B. Vance of Meridian, Mississippi, the former general sales manager of the Meridian plant of Borden, Inc., with rigging bids, in violation of Section 1 of the Sherman Act, submitted to school boards in certain school districts in Mississippi for the award and performance of contracts to supply dairy products to public schools in those districts, beginning at least as early as 1985 and continuing at least through August 1988.

One-count information was filed in U.S. District Court in Jackson, Mississippi, charging M.K. Ethridge of Meridian, Mississippi, the former general manager of the Meridian plant of Borden, Inc., with rigging bids, in violation of Section 1 of the Sherman Act, submitted to school boards in certain school districts in Mississippi for the award and performance of contracts to supply dairy products to public schools in those districts, beginning at least as early as 1985 and continuing at least through August 1988.

12/18/92 Justice Consents to Proposed Termination of Linen Judgment

The Department of Justice, Antitrust Division, filed a stipulation and memorandum in U.S. District Court for the Southern District of New York which, if approved by the Court, would terminate the Final Judgment. General Linen Supply & Laundry Co., Inc., Cascade Linen Supply Corp. of N.J., and NUS, Inc., as successor by acquisition of substantial assets of each of three other defendants in U.S. v. Linen Supply Institute of Greater New York. Inc.. et al., Civ. No. 99-387 S.D.N.Y.. filed a motion to terminate the Final Judgment in this case. The Department, in a stipulation also filed with the Court, has consented to termination of the Final Judgment, but has reserved the right to withdraw its consent for at least seventy (70) days after publication. In its papers, the Department indicated that the judgment should be terminated because its continuation no longer serves the public interest.
