One-count indictment
was filed in U.S. District Court in Philadelphia, Pennsylvania,
charging Louis J. Gaev, Director of National Sales for Russell-Stanley
Corporation of Red Bank, New Jersey, with fixing the prices, in
violation of Section 1 of the Sherman Act, of new steel drums
offered for sale to customers in Maine, New Hampshire, Vermont,
Massachusetts, Connecticut, Rhode Island, eastern New York, eastern
Pennsylvania, New Jersey, Maryland, Delaware, Virginia and the
District of Columbia, beginning sometime prior to April 1, 1986
and continuing at least through March 1990.

U.S. v. Beazer PLC
Civil No.: 92-1881 (D.D.C.)
Civil complaint was
filed in US District Court in Washington, D.C., seeking a civil
penalty from Beazer PLC of London, England, for violating the
premerger notification and waiting period requirements of the
Hart-Scott-Rodino Act. The complaint alleges that Beazer violated
the act between October 19, 1987 and March 18, 1988 when it failed
to comply with the act's notification and waiting period requirements
before acquiring more than $15 million of Koppers Company, Inc.'s
voting securities. The act permits a federal court, upon the Justice
Department's request, to assess a civil penalty of up to $10,000
for each day a party is in violation. A proposed judgment was
also filed which, if approved by the court, will settle the case
with Beazer paying $760,000.
