Bankruptcy Reform Act

Bankruptcy Abuse Prevention and
Consumer Protection Act of 2005 (BAPCPA)

Congress has opened a new era in the history of bankruptcy protections by the enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, which was signed into law on April 20, 2005 by President Bush. The Bankruptcy Reform Act gives the United States Trustee Program new areas of responsibility. Some of these areas are "means testing," "supervising random audits," certification of entities providing credit counseling," and "certification of entities providing financial education." This page will be updated with USTP website links regarding these new responsibilities as information is made available.
