Mission:

To develop, administer, and enforce Departmental policies, practices, and procedures under Title VI and Title VII of the Civil Rights Act of 1964; Section 188 of WIA; the Rehabilitation Act of 1973;the Age Discrimination Act of 1975; the Equal Pay Act; Title IX of the Education Amendments of 1972; Title II of the Americans with Disabilities Act, Secretary's Order 4-2000 and related statutes and Executive Orders which prohibit discrimination in programs and activities receiving Federal financial assistance; and to direct, implement, and manage the total Department of Labor (DOL) Equal Employment Opportunity (EEO) program to assure equal opportunity for all DOL employees and applicants for employment.

Functions:

  • Advises the Assistant Secretary for Administration and Management on DOL's overall civil rights program.

  • Develops and implements regulations, policies, and procedures to ensure the effective implementation of the Department's responsibilities under applicable equal opportunity and nondiscrimination statutes covering programs receiving DOL financial assistance.

  • Oversees the review of program implications of legislative proposals, new legislation, Executive Orders, regulations, or administrative actions to determine their impact on DOL's civil rights functions.

  • Monitors, on a nationwide basis, a wide variety of programs receiving financial assistance from the Department of Labor to assess their compliance with EO laws and regulations.

  • Plans and administers a nationwide equal opportunity compliance assistance and training program for DOL recipients and DOL employees.

  • Develops policies, procedures and guidance for the Department's EEO programs. Manages the EEO programs and provides compliance assistance and advice to DOL management on their responsibilities.

  • Develops and monitors a counseling and mediation system within the Department of Labor for resolving EEO and EO complaints.

  • Plans and manages systems for the filing, investigation, review, analysis, and conciliation of discrimination complaints against DOL, and/or recipients of financial assistance.

  • Administers a Civil Rights Mediation/Counseling program to resolve informal EEO complaints in the regional offices.

  • Develops and implements the DOL program that ensures accessibility for disabled persons to all DOL occupied facilities as required by the Architectural Barriers Act. Directs implementation of Section 504 of the Rehabilitation Act of 1973 which prohibits discrimination based on disability in programs or activities conducted by the Department of Labor.

  • Maintains information systems to collect and disseminate management information on compliance and enforcement activities.

  • Prepares reports on EO and EEO investigation and compliance activities for DOL officials, DOJ, EEOC, and other agencies.

  • Develops guidelines and informational materials to inform DOL management and recipients of Federal financial assistance of their responsibilities in the EEO and EO compliance programs. Develops and publishes information regarding the rights of DOL employees and program beneficiaries.

  • Establishes and maintains liaison with civil rights enforcement agencies, and with community and interest groups on EO and EEO matters of mutual concern.

  • Issues show cause notices and final determinations where recipient is in noncompliance; issues final determinations proposing sactions where the required corrective actions cannot be secured.

  • Issues initial and final determination on complaints in programs receiving financial assistance from DOL; issues final decisions on internal DOL EEO complaints.
  • Responsible for implementing the Department's harassing conduct in the workplace policiy.
