B.   Policy.

  1. To meet exceptional employment needs, the Department may seek OPM approval, on a case-by-case basis, of exceptions to the salary offset provisions in 5 U.S.C. 8344 and 8468 that would apply to reemployed civilian retirees who are under the Civil Service Retirement System or the Federal Employees' Retirement System.


  2. The Assistant Attorney General for Administration is the headquarters official who has been delegated the authority to request OPM approval to waive the salary offset provisions for annuitants. Waivers are appropriate to help the Department meet temporary emergency hiring needs or when the Department has encountered exceptional difficulty in recruiting or retaining qualified candidates for a particular position.
