SUBJECT:     Organ Donor Leave Act

This provides the attached Office of Personnel Management (OPM) memorandum and statement from the President concerning the Organ Donor Leave Act. On September 24, 1999, the President signed Public Law 106-56, the Organ Donor Leave Act, which increases the amount of paid time off permitted for Federal employees who become organ donors. The new law entitles an employee to up to 30 days of paid time off per calendar year to donate organs for transplant. The current provision of 7 days paid time off per calendar year for bone marrow donation remains the same.

The new law amends section 6327 of title 5, United States Code, which is attached. OPM believes the law is clear, and does not plan to issue regulations for administering 5 U.S.C. 6327. Please notify your employees of the new entitlement, which became effective on September 24, 1999. For time keeping purposes, the approval of time off to be an organ donor is recorded using Transaction Code 66, together with code “D” (for donor) in the Remarks block.
