Summary of Law(s) and Regulation(s):
Massachusetts State Law states a person may not drive, operate or be in physical control of a commercial motor vehicle while having alcohol in his system. A person who drives, operates or is in physical control of a commercial motor vehicle while having alcohol in his system or who refuses to take an alcohol concentration test to determine his blood alcohol content shall be placed out-of-service for twenty-four hours. Any person who operates a commercial motor vehicle upon the highways of the commonwealth shall be deemed to have given consent to a test or tests of that person's blood, breath or urine for the purpose of determining that person's alcohol concentration, or the presence of others drugs. A person requested to submit to a test as provided shall be advised that a refusal to submit to the test will result in that person being disqualified from operating a commercial motor vehicle.
