ORDER GRANTING MOTION TO STAY

   The parties to the above captioned proceeding are hereby notified that Administrative Law Judge Lawrence Brenner has left this office and transferred to another federal agency. As such, this matter will be assigned to a new administrative law judge in the near future.

   The parties to this case have, by Motion dated January 16, 1995, requested that this matter be stayed pending a determination by the U.S. Attorney for the Western District of Pennsylvania to pursue criminal indictments as a result of alleged conduct that the Complainant has testified was the basis for his dismissal from the Respondent, as well as to pursue criminal indictments against the Complainant for providing alleged false testimony to a Grand Jury and to the Nuclear Regulatory Commission.

   Upon consideration of the Joint Motion for Stay of Party Discovery filed in this matter, it is:

   ORDERED that party discovery, i.e., discovery requests by one party to the other party, in this proceeding is stayed pending further order; and it is

   FURTHER ORDERED that Counsel for the Respondent shall within the first week of each month file with this office a status report on the pending criminal investigation. All status reports should be addressed to the undersigned until this matter is assigned to an administrative law judge.
