In a letter dated May 3, 1999, to the Governor of Texas, the EPA determined that the Attainment Demonstration and post-96 rate of progress SIPs (received on March 18, 1999) for the Dallas/Fort Worth area are administratively incomplete. Specifically, the attainment demonstration contains neither a control strategy sufficient to attain the National Ambient Air Quality Standards, nor adopted rules to implement such a strategy; and the post-96 rate of progress plan is deficient on its face in that it fails to show the required emission reductions of three percent per year or a total of nine percent for the 1996 to 1999 timeframe. On June 2, 1999, EPA published a finding of failure to submit the required ozone Sips (64 FR 29570). EPA did not conduct an adequacy determination for the March 18, 1999 submissions as there were no Sips and thus no budgets to review. Therefore, the budgets contained in the March 18, 1999 submissions cannot be used for transportation conformity determinations. On August 26, 1999, EPA Region 6 explained this in a etter sent to the Texas Natural Resource Conservation Commission.
