WASHINGTON, D.C. 20554 DA 98-2554 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov December 16, 1998 CABLE SERVICES ACTION COMMISSION TO KEEP BOTH FCC FORM 1240 (ANNUAL UPDATE FORM) AND FCC FORM 1210 (UPDATE FORM) FOR CABLE RATE JUSTIFICATION PURPOSES In its Implementation of Sections of the Cable Television Consumer Protection and Competition Act of 1992: Rate Regulation, MM Docket No 92-266, Thirteenth Order on Reconsideration, the Commission introduced the annual cable rate adjustment option known as the FCC Form 1240 (Annual Update Form). The FCC Form 1240 joined the FCC Form 1210 (Update Form) as the means by which cable operators could justify their basic service tier or cable programming service tier rates on an annual or quarterly basis. According to Section 76.922(e)(4) of the Commission's rules, the Commission is required to determine, prior to December 31, 1998, whether the annual rate adjustment methodology should be kept, and whether the quarterly system should be eliminated and replaced with the annual rate adjustment method. (See 47 C.F.R. Section 76.922(e)(4)). The Cable Services Bureau has reviewed the filings of hundreds of cable operators since the introduction of the FCC Form 1240. While the majority of cable operators have adopted the annual adjustment method embodied in the FCC Form 1240, a significant number of cable operators have chosen to justify their cable rates using the quarterly method embodied in the FCC Form 1210. Because both forms and methodologies continue to be useful to cable operators in the justification of their cable rates, the Commission declines to eliminate either methodology and will continue to make available both the FCC Form 1210 and the FCC Form 1240.
