A station's market for this purpose is its "area of dominant influence," or ADI, as  S,- xydefined by the Arbitron audience research organization.6 ,ZTJ yO&-#X\  P6G;ɒP#эSection 614(h)(1)(C) of the Communications Act, as amended by the Telecommunications Act of 1996, provides that a station's market shall be determined by the Commission by regulation or order using, where  {O-available, commercial publications which delineate television markets based on viewing patterns. See 47 U.S.C. 534(h)(1)(C). Section 76.55(e) of the Commission's rules provides that the ADIs to be used for purposes of the  {OH!-initial implementation of the mandatory carriage rules are those published in Arbitron's 19911992 Television  {O"-Market Guide. The Commission recently concluded that it was appropriate to switch market definitions from ADIs to Nielsen Media Research's designated market areas ("DMAs") for mustcarry/retransmission consent  {O#-elections. See Definition of Markets for Purposes of the Cable Television Mandatory Television Broadcast Signal Carriage Rules, Report and Order and Further Notice of Proposed Rule Making, CS Docket No. 95178,  {O6%-11 FCC Rcd 6201 (1996) ("Market Modification Report and Order"). In its Market Modification Report and  {O&-Order, the Commission decided to use Arbitron's 19911992 Television ADI Market Guide market designations for the 1996 election and postpone the switch to Nielsen's DMAs until the mustcarry/retransmission consent  {O'-election that is to take place on October 1, 1999. The Commission also issued a Further Notice in its Market"',(( ("  {O-Modification Report and Order to solicit additional information and provide parties an opportunity to further consider issues relating to the transition to market designations based on Nielsen's DMAs. An ADI is a geographic market designation that",",((IIN" defines each television market exclusive of others, based on measured viewing.  S- ` x3.` ` Under the Commission's mustcarry rules, cable operators have the burden of showing that  S- xya commercial station that is located in the same television market is not entitled to carriage."( {OJ-#X\  P6G;ɒP#эSee Must Carry Order, 8 FCC Rcd at 2990. One method  xof doing so is for a cable operator to establish that a subject television station's signal, which would  xotherwise be entitled to carriage, does not provide a good quality signal to a cable system's principal  S- x/headend.y( yO -#X\  P6G;ɒP#э47 C.F.R. 76.55(c)(3).y Should a station fail to provide the requisite overtheair signal quality to a cable system's  S- xyprincipal headend, it still may obtain carriage rights because under our rules a station may provide a cable  xoperator with specialized equipment, at the station's expense, which will improve the station's signal to  S-an acceptable quality at a cable system's principal headend.l( {O-#X\  P6G;ɒP#эMust Carry Order, 8 FCC Rcd at 2991.  SH - ` x4.` ` In its complaint Paxson asserts that KWPXTV is entitled to mandatory carriage on  xSummit's cable systems serving Port Townsend, Duvall, and Lake Ames, Washington and surrounding  xareas. In support of this assertion, Paxson states that KWPXTV is licensed to Bellevue, Washington,  xwithin the Seattle, Washington ADI and that Summit's systems serving the communities are also within  xthe Seattle ADI. Paxson also asserts that Summit's carriage of KWPXTV will not increase copyright  xiliability for Summit. Paxson asserts that it attempted to work with Summit to demonstrate that KWPXTV  xdelivers a good quality signal to the principal headends of those cable systems, and that in the event  xKWPXTV does not deliver a good quality signal over Summit's principal headends serving the  xCommunities, it commits to acquire and install any and all equipment necessary to deliver a good signal to those headends.  S- ` x5.` ` In opposition, Summit states that signal level tests that have been taken show, and that  xzPaxson has conceded that KWPXTV fails to deliver a good quality signal to the headends of its cable  x<systems. In a reply filed September 30, 1998, Paxson confirms that KWPXTV does not currently provide  xLa signal of the requisite strength to Summit's cable systems principal headends. Paxson states that it has  xfiled an application with the Commission for authority to construct a new main transmitter for KWPXTV  x>at a different location. Paxson expresses confidence that the proposed new transmission facility will  xprovide a substantially improved signal to Summit's cable systems and will deliver a good quality signal to Summit's cable systems' headends, and requests the Commission to approve its request for carriage.  S(- ` Ԋx6.` ` Paxson's complaint is denied. Paxson concedes that KWPXTV does not deliver a good  xquality signal to the principal headends of Summit's cable systems and thus failed to establish that KWPX x>TV, utilizing current facilities, is a "local" station entitled to carriage on Summit's cable systems. We  xbelieve it premature to address the matter of whether a proposed and unbuilt station is a "local" station  xfor mustcarry purposes.
