False Claims Act

Three Westlaw databases provide information about the False Claims Act:

The False Claims Act: Fraud Against the Government (FCA): A treatise providing current and comprehensive treatment of the law that has developed under the False Claims Act for practitioners representing defendants, relators, or the Government, as well as judges, academics, and others who may be interested in the development and application of its model of shared public and private law enforcement.  Particular focus on liability to the government as well as to private individuals, damages, and other remedies, including civil penalties, the relator's share, and attorneys' fees and costs. Treatment is given to procedure in qui tam actions as well as the current state false claims laws modeled on the federal statute.

The False Claims Act and Qui Tam Quarterly Review (FCAQR): A legal journal published by Taxpayers Against Fraud (TAF) Education Fund, it focuses on litigation under the False Claims Act and its qui tam provisions. Included are articles from leading FCA practitioners and government attorneys, timely case summaries of all federal court opinions dealing with the Act to document the emerging trends in the case law, and up-to-date information on recent qui tam developments, Department of Justice interventions, and settlements.  Current through the July 2005 issue, updated quarterly.

Arnold & Porter Legislative History: False Claims Act of 1986 (FALSECLM-LH): Comprehensive legislative history of the False Claims Amendments Act of 1986, Pub. L. No. 99-562, compiled by Arnold & Porter, including the text of the public law as well as bills, committee reports, transcripts of hearings, and other documents.
