DOL Opinion Letters

The Wirtz Labor Law Library has in its print collection copies of most opinion letters issued by the Wage and Hour division (WHD) dated 1961 through 2004. In addition, the library has copies of Employee Retirement Income Security Act (ERISA) Advisory Opinion Letters dated 1977-1997. Not all WHD & ERISA opinion letters are included in the Law Library's print collection; some may not have been received by the Library as they may never have been "officially" published. Other resources that can be used to locate DOL opinion letters are described below.

Subscribers to Westlaw ( http://web2.westlaw.com/ ), a fee-based legal information service provided by West Publishing, can use the database FLB-WHOL to locate WHD opinion letters. See the previous tip “Wage and Hour Opinion Letters” for information about FLB-WHOL. LexisNexis ( http://www.lexis.com/ ), another fee-based legal information service, provides access to historical Wage and Hour Opinion Letters through the database CCHEMP/WHDLOL, “CCH Wages & Hours Department of Labor Opinion Letters”.

To locate ERISA Advisory Opinion Letters using Westlaw, use the database FPEN-ERISA. See the tip “ERISA Advisory Opinions” for more information about this database. LexisNexis also provides access to ERISA Advisory Opinion Letters dated October 1974 to current in several of its databases, including LABOR/ERISA, ADMIN/ERISA, and PENBEN/ERISA.

FLSA, FMLA, and Youth Employment Opinion Letters from to 2001 to current can be accessed via the the Wage & Hour Division's Opinion Letters page. The Employee Benefits Security Administration (EBSA) provides Advisory Opinions dated 1992-present on its Advisory Opinions main page.

The Zimmerman's Research Guide entry on the United States Department of Labor provides a comprehensive description of and information about locating DOL opinion letters in a variety of formats. Researchers can also contact the library for assistance locating older or hard to find opinion letters.
