Cross Border Safety Inspections for Motor Carriers - Programmatic Environmental Assessment

The National Environmental Policy Act (NEPA) and Council on Environmental Quality (CEQ) implement regulations and establish policies and procedures that ensure environmental information is available to decision makers, regulatory agencies, and the public before Federal actions are implemented. The FMCSA prepared three notices of proposed rulemakings (NPRMs), for the purpose of administering safety programs regulating Mexican carriers. The purpose of the three proposed rules is to protect the health and safety of the general public, by ensuring that Mexican carriers are willing and able to comply with U.S. requirements and by monitoring their compliance once they commence U.S. operations. The rules are being promulgated by FMCSA as part of a larger effort to assess and monitor the safety performance of Mexican carriers operating in the U.S. A Programmatic Environmental Assessment (PEA) is being drafted to discuss and assess the impacts of these actions. The PEA follows the procedures established by the Department of Transportation (DOT) to implement NEPA, pursuant to the CEQ regulations.

A team of Volpe Center environmental engineers and scientists, under the direction of Dr. Paul Valihura of the Environmental Engineering Division, is providing technical support to the FMCSA with the preparation of the PEA. The PEA is intended to be a decision tool that will be used by FMSCA to make informed decisions and to fully understand the environmental ramifications of those decisions. The PEA addresses the consequences of the three proposed NPRMs on human and natural environments, suggests potential mitigation of adverse impacts, and analyzes the no-action alternatives to the proposed actions.
