However, manufacturers cannot request an interpretation of the test procedure, or be required to petition for a waiver, if the test procedure underestimates the product's true energy consumption. EPCA further provides that if the efficiency levels in ASHRAE/IESNA Standard 90.1 are amended after that date for any of the covered equipment, as recently occurred, the Secretary of Energy must establish an amended uniform national standard for such equipment at the new minimum level for each effective date specified in ASHRAE/IESNA Standard 90.1, unless DOE determines that a more stringent standard is technologically feasible and economically justified and would result in significant additional energy conservation. Additionally, the Secretary may not prescribe any amended standard that increases the maximum allowable energy use or decreases the minimum required energy efficiency of a covered product. DOE published a NOA addressing whether to adopt the ASHRAE/IESNA standard for commercial 3-phase air conditioners and heat pumps less than 65kBtu/h; commercial packaged terminal air conditioners and heat pumps; commercial oil and gas fired packaged boilers; and tankless gas fired instantaneous water heaters. A final rule is planned to cover all products in the NOA except PTAC/PTHPs. DOE has identified PTAC/PTHPs for further rulemaking. In order to maintain the consistency and completeness of the Department's appliance test procedure regulations codified in 10 CFR 430 and 431 and to aid interested parties in locating and using the new regulatory information, DOE plans to promulgate test procedures for the products in EPACT 2005. However, DOE will need to review these test procedures to determine their adequacy for adoption in the Code of Federal Regulations and may conduct multiple rulemakings to adopt test procedures for these products.
