Proposed Decision to Deny Hazardous Waste Permit - Exide Technologies, Manchester, Iowa

INTRODUCTION

The U.S. Environmental Protection Agency (EPA) Region 7 invites the public to review and comment on the proposed decision to deny a hazardous waste permit application for the Exide Technologies site.  The public comment period will start on November 14, 2006, and will end on December 28, 2006.

EPA is proposing to deny the permit in order to release the facility from its interim status as a hazardous waste storage facility and its financial responsibility requirements.  This decision is based on EPA’s determination that no further corrective action is required under the Resource Conservation and Recovery Act regulations.

Exide Technologies is located at 913 S. 10th Street in Manchester, Iowa.

BACKGROUND

The facility, a manufacturer of lead-acid batteries, was formerly owned and operated as Prestolite Battery, Allied Battery, and General Battery, respectively.  The facility has been regulated as an interim status hazardous waste storage facility since 1980. 

The facility submitted a closure plan for the closure of four solid waste management units (SWMUs).  The four SWMUs were the Lead Storage Area, Waste Solvent Storage Area, Former Waste Storage Area, and Surface Impoundment.  Closure activities for the four SWMUs included environmental sampling for sulfate, pH, sodium, and lead contamination. 

The facility submitted closure certification reports to EPA, which documented the results of the closure activities and indicated that no further corrective action was necessary.  Thus, EPA concluded that all of the SWMUs had been closed according to the approved closure plan except for the Surface Impoundment.  EPA determined that time-of travel groundwater monitoring was needed in order to certify the Surface Impoundment closure.  Groundwater monitoring wells were installed at the facility and a semi-annual groundwater monitoring program was initiated. 

Several years later, EPA concluded that Exide Technologies could cease the semi-annual groundwater monitoring program after evaluating the semi-annual groundwater monitoring reports.  EPA based this decision on the stability of the measured groundwater quality parameters and estimates of groundwater flow/travel time calculations.  Also, EPA determined that the facility was in compliance with the financial responsibility requirements.

A formal public hearing has not been scheduled but will be held if there is sufficient public interest.  Requests for a public hearing must be made in writing to the EPA contact on page 1 and must state the nature of issues to be raised at the hearing.  EPA will evaluate any requests and hold a formal hearing if it finds that a hearing will contribute to the decision-making process by clarifying significant issues affecting the proposed permit denial.  EPA will make a final decision only after the public comment period ends and all comments are reviewed.
