ORDER OF DISMISSAL

    This case arises under the Federal State Extended Unemployment Tax Act of 1970, 26 USC § 3304 et seq.

    On April 24, 1996, the Department of Labor (DOL) notified Respondent of a debt collection in the amount of $15,783.00 for violations of the above-mentioned Act and regulations. DOL alleges that the grantees incurred the debt in questionable costs on audit reports. Respondent filed a request for administrative hearing on May 7, 1996. On May 22, 1996, this Office issued a Notice of Docketing and Pre-Hearing Exchange which required both parties to file certain information regarding this matter. Both parties filed the required information.

    Thereafter, on December 2, 1996, DOL filed a Stipulation of Dismissal with Prejudice.

    Pursuant to Rule 41(a)(1)(i) of the Federal Rules of Civil Procedure, it is hereby ORDERED that this matter be DISMISSED with prejudice.
