ORDER OF DISMISSAL

    This case arises under the Federal State Extended Unemployment Tax Act of 1970, 26 U.S.C. § 3304 et seq.

    On February 16, 1996, the Department of Labor (DOL) notified Respondent of a civil money penalty in the amount of $938.00 for violations of the above-mentioned Act and regulations. Respondent filed a request for administrative hearing on March 14, 1996. On April 5, 1996, this Office issued a Notice of Docketing and Pre-Hearing Exchange which required both parties to file certain information regarding this matter. On May 7, 1996, DOL filed a letter stating that a settlement had been agreed to and the parties would be filing a Stipulation of Dismissal. The parties filed the Stipulation of Dismissal on June 21, 1996.

    Accordingly, it is hereby ORDERED that this matter be DISMISSED with prejudice.
