MOTION OF THE UNITED STATES FOR LEAVE TO FILE EXHIBIT

Plaintiff United States respectfully moves the Court for leave to file an additional exhibit -- Attachment A to this motion -- to the Memorandum in Support of Plaintiff United States' Motion for a Scheduling and Case Management Order. Inclusion of this exhibit is necessary to ensure that there is a complete record of the hearing that took place before the Court on October 28, 2003. During that hearing, counsel for the United States referred to the document in the course of its argument on the parties' cross-motions for a scheduling and case management order. The United States therefore requests that Attachment A be filed as a sealed exhibit to its Memorandum.

Pursuant to Local Rule 7(m), counsel for the United States has raised the subject of this motion with counsel for the Defendants, who stated they have no objection.

A proposed order granting this Motion is included as Attachment B.
