FINAL DECISION AND ORDER

   Before me for review is the Recommended Decision and Order (R.D. and O.) of Administrative Law Judge (ALJ) Nicholas J. Laezza in the above-captioned case, which arises under the employee protection provision of the Surface Transportation Assistance Act of 1982, 49 U.S.C. app. § 2305 (1982).

   Upon a thorough review of the record in this case, I conclude that the ALJ's factual findings are supported by substantial evidence, and are thus conclusive. 29 C.F.R. § 1978.109(c)(3) (1987). Furthermore, I find that the ALJ's rulings are in accordance with law. Accordingly, I adopt, and append hereto, Judge Laezza's R.D. and O. of July 7, 1988, ordering Respondent to pay Complainant the sum of three thousand seven hundred eighty-eight dollars and forty-five cents ($3,788.45).
