CASE NO. 88-STA-0004
IN THE MATTER OF
JOHN W. TAYLOR,
COMPLAINANT,
v.
T.K. TRUCKING, INC.,
RESPONDENT.
BEFORE: THE SECRETARY OF LABOR
FINAL DECISION AND ORDER
Before me for review is the Recommended Decision and Order (R.D.
and O.) of Administrative Law Judge (ALJ) Nicholas J. Laezza in the above-captioned case,
which arises under the employee protection provision of the Surface Transportation Assistance
Act of 1982, 49 U.S.C. app. § 2305 (1982).
Upon a thorough review of the record in this case, I conclude that the
ALJ's factual findings are supported by substantial evidence, and are thus conclusive. 29 C.F.R.
§ 1978.109(c)(3) (1987). Furthermore, I find that the ALJ's rulings are in accordance with
law. Accordingly, I adopt, and append hereto, Judge Laezza's R.D. and O. of July 7, 1988,
ordering Respondent to pay Complainant the sum of three thousand seven hundred eighty-eight
dollars and forty-five cents ($3,788.45).
