ORDER OF DISMISSAL DUE TO SETTLEMENT

    On January 31, 1989, the Regional Solicitor's office submitted for my approval a Memorandum of Understanding which sets forth the terms of a settlement entered into by the parties and the Assistant Secretary for Occupational Safety and Health (OSHA).

    Since the Assistant Secretary has agreed to the settlement, my approval of the settlement terms is not required. Notice to me of the settlement is sufficient. 29 C.F.R. § 1978.111. See Kidd v. Sharron Motor Linesm, Inc., Case No. 87-STA-2, issued July 30, 1987. Accordingly, the complaint in this case is DISMISSED.
