FINAL DECISION AND ORDER

    Before me for review is the Recommended Decision - Denying Complaint, issued on July 30, 1986, by Administrative Law Judge (ALJ) Anthony J. Iacobo in the above-captioned case which arises under the employee protection (whistleblower) provision of the Surface Transportation Assistance Act of 1982 (STAA), 49 U.S.C. app. § 2305(b) (1982).

    After careful consideration of the facts stipulated to by the parties and the exhibits in the record, I adopt the findings set forth in Judge Iacobo's decision, a copy of which is appended hereto, and accept his conclusion that Complainant failed to establish that Respondent violated section 2305(b) of the STAA.

    Accordingly, the complaint is DISMISSED.
