ORDER OF DISMISSAL

   By Motion received May 3, 2004, counsel for Complainant seeks a voluntarily dismissal of this action, stating that the U. S. Department of Labor no longer has subject matter jurisdiction inasmuch as the action has been removed to the U. S. District Court. Respondent does not oppose Complainant's Motion; however, requests that the dismissal be with prejudice. Complainant's motion is GRANTED and the case before this office stands DISMISSED.

   So ORDERED this 21st day of May, 2004, at Metairie, Louisiana.
