DATE: September 12, 1995
CASE NO. 94-TSC-5

IN THE MATTER OF

JUDY K. STEPHENSON,

          COMPLAINANT,

     v.

NATIONAL AERONAUTICS & SPACE
ADMINISTRATION,

          RESPONDENT.

BEFORE: THE SECRETARY OF LABOR

ORDER GRANTING NASA MOTION FOR RECONSIDERATION
                          AND STAY OF PROCEEDINGS

Before me for review is a Motion For Reconsideration and
Stay of Proceedings filed by the Respondent in this case arising
under the employee protection provision of the Clean Air Act
(CAA), 42 U.S.C. § 7622 (1988). Respondent's motion
concerns an August 21, 1995, Secretary's Decision and Order of
Remand (D. and O.) that rejected a Recommended Order Granting
Motion to Dismiss issued by an Administrative Law Judge (ALJ) on
August 4, 1995. Upon reexamining the case in light of
Respondent's motion, I have determined that further consideration
is necessary. Accordingly, the motion is granted. The D. and O.
will be reconsidered, and the proceedings hereby are stayed.
     SO ORDERED.
