                        U.S. DEPARTMENT OF LABOR

                           SECRETARY OF LABOR
                            WASHINGTON, D.C.

DATE: June 19, 1995
CASE NO. 92-TSC-00006
          92-TSC-00008

IN THE MATTER OF

DOUGLAS COUPAR,
          COMPLAINANT,

     v.

FEDERAL PRISON INDUSTRIES
(UNICOR),
          RESPONDENT.

BEFORE: THE SECRETARY OF LABOR

                                     ERRATUM

The Final Decision and Order in this case is amended to read
as follows: The Administrative Law Judge (ALJ) submitted a
Recommended Decision and Order in this case arising under the
employee protection provisions of the Clean Air Act, 42 U.S.C.
§ 7622 (1988), and the Toxic Substances Control Act, 15
U.S.C. § 2622 (1988), recommending that relief be awarded to
the complainant. For the reasons set forth in my decision in
Coupar v. Federal Correctional Institution, El Reno,
Oklahoma, Case Nos. 90-TSC-00001, 91-TSC-00003, Sec'y. Dec.
Feb. 28, 1995, I find that Complainant is not an employee covered
by those laws and the complaint in this case is DISMISSED.

     SO ORDERED.

                                        ROBERT B. REICH
                                        Secretary of Labor

Washington, D.C.
