RECOMMENDED DECISION AND ORDER
This action arises under the Toxic Substances Control Act
("Act"), 15 U.S.C. §2601 etseq. The Act prohibits,
among other things, covered employers from discharging or otherwise discriminating against an
employee who has engaged in any activity protected by the Act.1
1The relevant section of the Act states
that "[any employee who believes that [he] has been . . . discriminated against in violation
of subsection (a) of this section may, within 30 days after such violation occurs, file . . . a
complaint with the Secretary of Labor . . . alleging such . . . discrimination."
3Although the original complaint
which Amato filed with the Department of Industrial Relations on April 14, 1998, does not set
forth the specific details concerning his alleged wrongful termination, the notations on the April
20, 1998, letter show that such details were provided to the department.
