CASE NO. 91-TSC-00001

IN THE MATTER OF:

GUY HELMSTETTER,
   Complainant,

   vs.

PACIFIC GAS & ELECTRIC
CO.,
   Respondent.

ORDER OF DISMISSAL

A hearing was held in this matter on May 17, 1993. At that time, the complainant moved for default judgment on the ground that the respondent had not participated in discovery in good faith. That motion was denied. The parties were admonished to advise this office when a hearing was necessary but only after all discovery had been completed.

By order dated July 28, 1998, the parties were ordered to show cause in writing within 30 days of the order why this case should not be dismissed with prejudice. Because neither party has responded to the order to show cause, this case is DISMISSED WITH PREJUDICE for failure to prosecute.
