ORDER

    On July 26, 1988 I issued an Order of Stay in this matter for the reasons stated in the Order. Subsequently, on October 4, 1988 I issued a Notice to Parties. This matter is before this Office on Ms. Pogue's appeal of the Department of Labor's July 7, 1988 determination. But for a carbon copy of Ms. Pogue's counsel's April 12, 1989 letter to the Secretary on neither this matter, nor on the Barbara Pogue v. U.S. Department, Case 87-ERA-21 (Pogue I) matter, has this Office, to date, heard or been advised of any events post-October 4, 1988 order. This letter would indicate the Pogue I matter was still on appeal.

    Therefore the Complainant, Barbara Pogue, and the U.S. Navy shall, by this Order, within 20 days of its date file with this Office a response which reflects the current status of the Pogue I appeal, on the disposition of which this Pogue II current appeal was stayed; as well as their position as to this office's handling, as of this date, under Part 24 of 29 C.F.R., of Ms. Pogue's appeal of the Department of Labor's July 7, 1988 determination.

    It is so ORDERED.
