ORDER VACATING THE FINAL JUDGMENT AND DISMISSING THE ACTION

The Court having been fully informed of the reasons for the parties' Joint Motion to Vacate the Final Judgment (the "Foreign Decree") and Dismiss This Action Without Prejudice, and all interested parties having been afforded the opportunity to comment on that motion,

It is hereby ORDERED

(1) Upon the effective date of the Second Amended Final Judgment entered in United States v. American Society of Composers, Authors and Publishers, Civ. Action No. 41-1395 (S.D.N.Y.), the Final Judgment in this action is vacated; and

(2) Upon the effective date of the Second Amended Final Judgment entered in United States v. American Society of Composers, Authors and Publishers, Civ. Action No. 41-1395 (S.D.N.Y.), this matter is dismissed without prejudice.
