RECOMMENDED ORDER OF DISMISSAL

   This case arises under the employee protection provisions of the Solid Waste Disposal Act (SWDA), 42 U.S.C. § 6971, and the Comprehensive Environmental Response Compensation and Liability Act (CERCLA), 42 U.S.C. § 9610.

   On June 27, 1990, the parties to this case submitted a fully executed Settlement Agreement and Release, along with a proposed Consent Order of Dismissal. After review of the terms of the proposed settlement agreement, it is found that the agreement is fair, adequate, reasonable, and in the public interest.

   Accordingly, it is recommended that the Settlement Agreement and Release, as fully encompassed within the four corners of the executed document, be approved and that this case be dismissed with prejudice.
