ORDER OF DISMISSAL WITH PREJUDICE

   This matter arises pursuant to the Solid Waste Disposal Act, 42 U.S.C. § 6971, and the regulations issued thereunder. This proceeding was referred to the Office of Administrative Law Judges pursuant to 29 C.F.R. Part 24.

   This Office has received an answer from Complainant to an Order to Show Cause issued by the undersigned directing Complainant to show cause why the above-captioned case should not be dismissed for failure to state a claim not already adjudicated. Upon inspection of the issues raised in Robert J. Faulkner v. Olin Corporation, 85-SWD-3 (1985) and the issues raised in the answer to the Order to Show Cause, I find no now issues to be raised.

   As this matter has been adjudicated, I hereby ORDER that the above-captioned case is DISMISSED with prejudice for failure to state a claim not already adjudicated.
