FINAL DECISION AND ORDER OF DISMISSAL

    This case arises under the employee protection provision of the Energy Reorganization Act of 1974, as amended (ERA), 42 U.S.C. § 5851 (1982). Before me for review is the [recommended] Order of Dismissal issued on November 21, 1985, by Administrative Law Judge (ALJ) Richard E. Huddleston and recently forwarded to me. 29 C.F.R. § 24.6(a) 11988). The record reveals that prior to a hearing on his complaint, Petitioner notified the ALJ by letter from his counsel dated November 12, 1985, that he had withdrawn his complaint in this case.

    Upon review of the record in this case and the [recommended] order of Dismissal, I accept the ALJ's recommendation. Accordingly, the complaint in this case is hereby DISMISSED.
