    In an order dated November 21, 1984, Administrative Law Judge (ALJ) Frank J. Marcellino recommended that the complaint in this case, arising under the Energy Reorganization Act of 1974, 42 U.S.C. § 5851, be dismissed with prejudice. The ALJ's recommendation is in accord with a request of Complainant, represented by counsel, that his complaint be dismissed with prejudice. The ALJ's recommendation is therefore accepted.

    Accordingly, the complaint is DISMISSED.
