NOTICE TO SUBMIT PROGRESS REPORT

    On February 21, 1991, counsel for Respondent advised the Secretary that the parties in this case arising under the Employee Protection Provision of the Energy Reorganization Act of 1974, as amended (ERA), 42 U.S.C. SS 5851 (1988), had reached a settlement "in principle" and expected to submit an appropriate notion in the near future. No such motion has been received.

    The parties should submit a report to the Secretary on their progress in reducing their settlement to writing within 30 days from the date of this notice. The parties should take note that, if significant progress has not been made to reach a written settlement in the near future, the Secretary will proceed to consider and decide the outstanding issues in this case.
