Deputy Chief Administrative Law Judge E. Earl Thomas submitted
a Recommended Decision and order to me in this case arising under
section 5851 of the Energy Reorganization Act of 1974 as amended,
on November 29, 1983. After careful and thorough consideration
and evaluation of all the testimony and exhibits in the record,
and proper application of the law as set forth in my decision in
Dean Dartey v. Zack Company of Chicago, 82-ERA-2 April 25, 1983,
Judge Thomas recommended, that the complaint in this case be denied.
I adopt Judge Thomas' decision in all respects and, accordingly,
this matter is DISMISSED.
