The United States Court of Appeals for the Fifth Circuit
reversed the Secretary's Decision of June 10, 1983 in this
case, holding that the filing of nonconformance reports by
Mr. Atchison was not a protected activity under 42 USC § 5851.
The employee protection provision of the Energy Reorganization
Act of 1974, as amended, therefore, is not applicable here,
and this case is DISMISSED.
