Decision and Order of Dismissal
This matter arises pursuant to a complaint filed with
the Office of Administrative Law Judges pursuant to Section
210 of the Energy Reorganization Act, 42 U.S.C. §5851.
On July 23, 1986, this Office received Complainant's
request for dismissal of the complaint. The Rules of
Practice aid Procedure for this Office permit a case to be
dismissed upon such request by the Party who filed the action.
A request for hearing may be
dismissed upon its abandonment or
settlement by the party or parties
who filed it. 29 C.F.R. §18.39(b)
Since the Complainant, the party who requested the

hearing, has now settled this matter. The case shall be
dismissed.
Accordingly, I hereby ORDER that the above-captioned
case is DISMISSED with prejudice. Furthermore, the hearing
scheduled in Knoxville, Tennessee is CANCELLED.
