ORDER DISMISSING CLAIM
This matter arises under the provisions of the Energy
Reorganization Act, 42 U.S.C. 5821 and the applicable regulations, 29
C.F.R. Parts 18 and 24.
A hearing was held on April 25, 1985 in Syracuse, New York. When
the complainants failed to appear, Stone and Webster moved for summary
judgment.
As required by regulation, an Order to Show Cause was issued
[Page 2]
May 3, 1985. The Order directed the complainants to respond within
fifteen days of the Order's entry. Neither complainant has responded.
Therefore, pursuant to 20 CFR § 24.5(e)(4), it is ordered that the
complaints filed by John P. Daly and W. Gordon Dick be dismissed for
failure to prosecute.
