ORDER GRANTING MOTION FOR JOINDER OF
ILLINOIS POWER COMPANY AS A PARTY-IN-INTEREST
On February 29, 1984, Complainants, through
counsel, filed a Motion for Joinder of Illinois Power Company as a
Party-in-Interest. On March 8, 1984, Illinois Power Company and
Respondent were ordered to show cause why the motion should not be
granted. Illinois Power Company filed a response on March-19, 1984,
and a Supplemental Memorandum on March 29, 1984. On April 12, 1984,
I issued an Order denying the Motion for Joinder. The basis for
denial was that the issue of joinder became moot when I granted
Respondent's Motion for Summary Decision.
The Secretary of Labor issued a Decision and
Order of Remand on March 12, 1986. Upon finding that the summary
decision was not warranted, the Secretary vacated my order denying
the Complainants' motion for joinder and directed me to consider it
anew.
Upon reconsideration, pursuant to Rule 19 of the
Federal Rules of Civil Procedure, I hereby grant the motion for
Joinder of Illinois Power Company as a party-in-interest.
