                         ORDER OF DISMISSAL

     The above-entitled case arises from a complaint filed by
Raymond G. Ford under the Surface Transportation Assistance Act of
1982, 49 U.S.C. §2305 and its implementing regulations found
at 29 C.F.R. Part 1978.  On May 25, 1994, the undersigned issued a
Notice of Hearing and Prehearing Order scheduling the above-
entitled case for hearing on September 13, 1994, in Grand Rapids,
Michigan.  
     On July 29, 1994, the undersigned received a letter from the
Complainant stating, "I would like to withdraw my apeal [sic]
request."  
     Pursuant to 29 C.F.R. §1978.111(c), IT IS ORDERED that
the Complainant's request for withdrawal is hereby granted, and the
Secretary's Findings issued on April 6, 1994, are hereby reinstated
and affirmed as unopposed.  
     IT IS FURTHER ORDERED that the Complainant's request for
hearing dated May 9, 1994, is hereby dismissed with prejudice.  The
hearing scheduled for September 13, 1994, in Grand Rapids, Michigan
is cancelled.
