Henthorne v. Carter, 87-SDW-1 (Sec'y Aug. 21, 1987)

U.S. DEPARTMENT OF LABOR

SECRETARY OF LABOR
WASHINGTON, D.C.

DATE: August 21, 1987
CASE NO. 87-SDW-1

IN THE MATTER OF

KAREN HENTHORNE,
    COMPLAINANT,

    v.

JOHN CARTER, CITY ADMINISTRATOR,
CITY OF MARYSVILLE, KANSAS,
    RESPONDENT.

BEFORE: THE SECRETARY OF LABOR

ORDER APPROVING SETTLEMENT

On June 19, 1987, Administrative Law Judge (ALJ) Robert J. Feldman issued a Recommended Order in the above-captioned case which arises under the employee protection provision of the Safe Drinking Water Act, 42 U.S.C. § 300j-9(i) (1982). The ALJ's order sets forth the specific terms of settlement agreed to by the parties and recommends that I approve the settlement.

I have reviewed the terms of the parties' agreement, and find that the agreement is fair, adequate and reasonable. I therefore approve the settlement and adopt as my final order the Recommended Order of the ALJ, a copy of which is appended.

Accordingly, the complaint in this case is DISMISSED.

    SO ORDERED.

       WILLIAM E. BROCK
       Secretary of Labor

Washington, D.C.
