ORDER RECOMMENDING APPROVAL OF SETTLEMENT
This proceeding arises under the the employee protection
provisions of seven federal environmental statutes: the Clean
Water Act, also known as the Water Pollution Control Act, 33
U.S.C. §1367; the Energy Reorganization Act, 42 U.S.C.
§5851; the Clean Air Act, 42 U.S.C. §7622; the Safe
Drinking Act, 42 U.S.C. §300j-9(i); the Solid Waste Disposal
Act as amended by the Resource Conservation and Recovery Act, 42
U.S.C. §6971; the Toxic Substances Control Act, 15 U.S.C.
§2601; and the Comprehensive Environmental Response, Compen-
sation and Liability Act, 42 U.S.C. §9610. The parties have
entered into a settlement agreement, attached hereto and incorpo-
rated by reference herein. I find that the terms of the
settlement are fair, adequate, and reasonable. Accordingly, the
hearing scheduled in this matter is cancelled, and
IT IS HEREBY RECOMMENDED that the Secretary enter a final
order approving the settlement agreement and ordering dismissal
of the complaint with prejudice.
