FINAL DECISION AND ORDER

    This matter arises under the employee protection provision of the Energy Reorganization Act of 1974, as amended (ERA), 42 U.S.C. SS 5851 (1982). Before me for review is the [recommended] Order of Dismissal issued on June 31 1988, by Administrative Law Judge (ALJ) Robert L. Hillyard. The record reveals that prior to a hearing on his complaint, Complainant notified the ALJ by Mailgram dated June 1, 1988, that he wished to drop this action against Gem Industrial Contractors.

    Upon review of the record in this case and the [recommended] Order of Dismissal, I accept the ALJ's recommendation. Accordingly, the complaint in this case is hereby dismissed.
