ORDER OF REMAND
A complaint was filed on September 19, 1990, by Allen Mosbaugh
against Georgia Power Company in which he alleged discriminatory conduct
on the part of Georgia Power Company.
The file in this case contains a letter dated September 24, 1990,
from the District Director to Allen Mosbaugh. This letter states that
the complaint has been assigned to Compliance Officer Franklin Pierce
for further action. However, the file does not contain the results of
such action. The letter setting forth the results of the investigation
of the complaint refers to an earlier complaint dated August 23, 1990.
This earlier complaint is the one which has been appealed and apparently
is the one which has been docketed as 90ERA58.
Due to the mix-up in the records and the fact that no determination
has teen made as to the September 19, 1990, complaint, it is hereby

ORDERED that this case be remanded to the District Director
for appropriate action.
