RECOMMENDED ORDER OF DISMISSAL WITH PREJUDICE

    Came on this date to be considered Complainant's Motion for Voluntary Dismissal Without Prejudice filed September 18, 1989 and the responses filed by Brown & Root and Texas Utilities dated September 25, 1989.

    Subsequently, the Court has also received a letter from Counsel for Complainant, Daniel I. Oshtry, Esq., dated September 29, 1989 indicating that all parties are agreeable to a dismissal with prejudice with the understanding that Complainant will not be assessed costs. Complainant personally has submitted a letter dated September 29, 1989 indicating his agreement to this disposition. As all parties are in agreement regarding the conditions of dismissal with prejudice, the Court will grant the DISMISSAL pursuant to Rule 41, Federal Rules of Civil Procedure.

    It is, therefore, ORDERED, ADJUDGED and DECREED that this case is hereby DISMISSED with PREJUDICE.
