Notification of Abatement and Training

EPA requires certified lead abatement professionals to notify the Agency prior to conducting lead-based paint abatement activities. EPA also requires accredited training programs to notify the Agency prior to and following completion of lead-based paint activities courses. These notification requirements are necessary to provide EPA compliance monitoring and enforcement personnel with information necessary to track lead-based paint abatement and training activities, and to prioritize compliance inspections.

When do I have to notify EPA about abatement activities?

A certified firm must notify EPA at least 5 business days prior to conducting lead-based paint abatement activities, with one exception. When abatement activities are required in response to either an Elevated Blood Lead Level determination or emergency abatement order, notice must be provided no later than the day abatement activities began. In addition, a the firm must notify EPA of any of the following changes to the original notice:

  • If the abatement activity will begin before the original start date, or if the location changes, notice must be provided at least 5 business days before the start date.
  • If the abatement activity is delayed, notice of the new start date must be provided to EPA on or before the original start date.
  • For other changes, such as cancellation, notice must be provided on or before the start date, or after work has begun within 24 hours of the change.

When do I have to notify EPA about training activities?

The accredited trainer must notify EPA at least 7 business days prior to offering a lead-based paint activities course, and within 10 business days of completing the course. In addition, the trainer must notify EPA of any changes to the original notice:

  • If the course will begin before the original start date, or if the location changed, notice must provided at least 7 business days before the start date.
  • For other changes, such as cancellation or delay, notice must be provided at least 2 business days prior to the start date.

What is required in each notification?

  • Pre-training notice
    • Notification type (original, update, cancellation);
    • Training program name, EPA accreditation number, address, and phone number;
    • Course discipline, type (initial/refresher), and the language in which instruction will be given;
    • Date(s) and time(s) of training;
    • Training location(s) phone number, and street address;
    • Principal instructors name; and
    • Training manager's name and signature.
  • Post-training notice
    • Training program name, EPA accreditation number, address, and phone number;
    • Course discipline and type (initial/refresher);
    • Date(s) of training;
    • Training managers's name and signature; and
    • The following student information: name, address, date of birth, course completion certificate number, and course test score.
  • Abatement notice
    • Notification type (original, updated, cancellation);
    • Date when abatement activities will start;
    • Date when abatement activities are expected to end;
    • Firm's name, EPA certification number, address, phone number;
    • Type of building;
    • Property name (if applicable);
    • Property address, including apartment or unit number;
    • Documentation showing evidence of an EBL determination or a copy of the Federal/State/Tribal/Local emergency abatement order (if applicable);
    • Name and EPA certification number of the project supervisor;
    • Approximate square footage/acreage to be abated;
    • Brief description of the abatement activities being performed; and
    • Name, title, and signature of the representative of the certified firm who prepared the notification.

Can I submit the notification online?

Yes, EPA’s Central Data Exchange (CDX) makes it easy to submit lead program notifications electronically. It’s fast and it’s free. You must first register for a CDX account (link to CDX registration). Then, skip the paperwork and fax machines, save a stamp, and use CDX. Give it a try!

Are there sample forms that I can use?

Yes, sample forms are available to facilitate the notification process. These forms are fillable and can be completed at your computer, or printed and completed by hand. Other forms are also acceptable if all of the required information is included.


Do these requirements apply everywhere?

No, these requirements only apply in those States and Indian country without authorized lead programs.
