ORDER OF DISMISSAL

   On February 26, 1999, the Administrative Review Board issued a Decision and Order of Remand which adopted and affirmed the findings and conclusions in the Decision and Order I issued in this matter on December 3, 1997. The Board remanded the matter solely for the purpose of determining attorney's fees and costs.

   Pursuant to the Board's Order, I issued, on March 15, 1999, an order Granting Time to Apply for Attorney Fees. That order allowed Complainant 30 days to file a petition for fees, and afforded Respondent 15 days from the date of receipt of the petition to file appropriate comments or objections.

   Complainant having declined to file a petition for fees, and the time for filing a petition having expired, Accordingly:

ORDER

   IT IS ORDERED that the matter of attorney's fees and costs, be and it hereby is, dismissed.
