ORDER OF DISMISSAL

   This proceeding arises under Section 405 of the Surface Transportation Assistance Act of 1982 [49 U.S.C. § 31105] and the regulations promulgated thereunder [29 C.F.R. Part 1978]. The parties, on September 3, 1999, filed a Joint Stipulation for Dismissal with Prejudice, set-tling the case in accordance with 29 C.F.R. § 1978.111 (d)(2). The joint stipulation resolves the parties' controversy arising from the April 9, 1999, complaint of Mr. Korolev under the pertinent statute. The Joint Stipulation for Dismissal with Prejudice is signed by complainant's counsel and respondent's counsel. Copies of the Joint Stipulation for Dismissal with Prejudice are attached only to the copies of this Order to be served on the parties.

   After carefully considering the Joint Stipulation for Dismissal with Prejudice, which is incorporated herein by reference, I find it to be fair, adequate and reasonable, and therefore approve said Joint Stipulation. Accordingly, IT IS HEREBY ORDERED, that the complaint fled by Alexander Korolev is dismissed with prejudice.
